SC stops police from further action on Isha Foundation premises

NEW DELHI: Supreme Court on Thursday took exception to a huge posse of Tamil Nadu police personnel descending on the premises of Sadhguru 's Isha Foundation , restrained the police from taking further action while also transferring to itself the case from Madras HC which had asked cops to inquire into the complaints against the popular ashram. You cannot let an army of police into an establishment like this, said a bench of Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra. Madras HC's directive to police to investigate the popular ashram came in response to the complaint of the parents of two women who have joined the ashram and have become monks. The parents had alleged that their daughters had been been held hostage at the ashram.

Deviating from the normal procedure, the bench decided to grant hearing after mentioning of the case. The judges went into the chamber to interact with the two monk sisters through video conferencing and passed the order. The court said that the sisters told it that they were not living there under any compulsion and they were free to move anywhere. They also blamed their parents for indulging in harassment for the last eight years. Coming in support of the Foundation, Centre also pleaded that SC's interference was required in the case.

Senior advocate Mukul Rohatgi, appearing for the organisation, sought an urgent hearing saying that 500 police personnel had entered the campus and alleged that HC erred in passing an order on plea of a father of two lady monks who have been living willingly in the premises. Rohatgi at the end of the proceeding said that it was not 500 but 150 police personnel who had entered the ashram.

The bench stayed the Madras HC order against the Foundation and transferred the case in HC to itself. The court recorded a submission made by the organisation that a similar petition was filed in the HC eight years ago by the mother of two sisters raising the same issue. The court also mentioned the statement made by the sister that their parents had visited them in the ashram on several occasions and one of them had participated in a 10 km marathon run recently.
